Legal Question in Family Law in Texas

Seperation

My husband and I are in huge disagreement. I want to serpentine for a while and try to work on things. We have one daughter. I told him we should do 50 50. Which means I get her half the time and he gets her the other half, and on Sundays we spend time as a family. I am willing to compromise, but he is not. I don't want to take our daughter from him, but he is intending to do that to me. He says that she would be better of with him. I say that we share and both be a part of her life. I feel like I am doing the right thing, but I feel like he is going to screw me because I want him to be a big part of her life. My question is since neither one of us want to divorce, and continue to try... how do we decide who keeps her. I want to share he wants her for himself. I think that is fair. We need an authority figure to say... This is what you need to do and this is where she needs to stay. I know this sounds ridiculous, but I just want to separate for a while and we cant agree on who keeps her. He is a great dad just a crappy husband, to be honest. He is verbally abusive to the fullest extent. That is why I want a break. I want to do the best for our daughter, and he does not even want to compromise. Does this make any sense

Re: Seperation

Does it make sense? Of course not. For some reason, some people see children as toys to use to hurt the other spouse. But if you want to do as you speak, you can file a Suit Affecting the Parent Child Relationship and seek to determine the custody arrangement that way. If the separation doesn't work out (and it does not look good in your question), then you can change the language and pursue a divorce. Might be better if you got a good family law attorney for this. Good Luck.
