Legal Question in Family Law in Texas

seperation/moving back in

My husband and I have been

seperated in Texas for 5 years. I live

in the house with the kids, he moved

out 5 years ago. He's hinting he's

moving back in. How can I keep him

from doing that?

Re: seperation/moving back in

Based on what you have written, you should consider filing a petition for divorce and then obtaining some temporary orders. If my local family law firm can assist you with this legal issue or any other legal matter, please contact my paralegal Tina ([email protected]) to arrange for an initial consultation.

Re: seperation/moving back in

You need to speak with an attorney who can assist you. You seem to need to file a petition for divorce and request the Court to schedule a hearing for the entry of temporary orders during the pendency of this case. The Court can decide who has the right to exclusive possession of what assets during this case. I am a board certified specialist in the field of family law, practicing in the general Houston area. File suit for divorce and request a temporary hearing. At the temporary hearing the judge will determine who should have possession of the house - because of the history, it will probably be you with the kids. I suggest you hire a lawyer to assist you.
