Legal Question in Family Law in Texas

I have served my ex-husband with papers requesting that my geographical restriction be lifted so that my 3 kids and I can move out of state (remarriage reasons). If he does not respond in 20 days from the date of service, is it as simple as me automatically being granted my request to move?

However, you should not rely on my answer as legal advice as I do not know all of the facts in your case. My best advice to you is to consult with a local family law attorney.

The Judge in the court that has continuing jurisdiction of the suit affecting the parent child relationship (usually where you got your divorce) will have jurisdiction over this matter.

You do not automatically get what you want when your ex doesn't answer / respond; the judge will still have to decide whether your proposed modification is in the "best interest of the children".
