Legal Question in Family Law in Texas

I was served a motion for enforcement of medical support order in Grayson County TX, on August 11th. My ex supplied me with receipts in January of 2010 for medical reimbursement. According to my divorce decree I owe 50% of medical expenses not paid by insurance in most cases.

I agree with most of the medical expenses and have been paying them to her every month as much as I can pay. I am currently in a Chapter 13 bankruptcy and my budget is very limited. There is only one medical expense that I do not agree with. My ex entered into a contract with an orthodontist in early 2007 for my daughter who was 11 at the time. We did not divorce until February of 2008. I did not agree with the decision to do this but my ex said it was not a big deal as her mother is paying for the entire bill. She went ahead with the orthodontist contract for braces. The bill was paid over the course of 2 and a half years and she supplied me with the payment ledger in January of 2010 asking for half. She did not go through my insurance at the time because they would not cover cosmetic procedures. I do not feel like I should pay half of this medical expense as it is cosmetic and the only reason she went through with it is because her mother was footing the bill. Added, the bill is $3000 (for half) and I do not have the money to pay it. I am at a loss as to what to do.

Also, what is the best way to answer the motion? Any forms I need to file? I do not have money for an attorney in my budget. (**need to answer court or attorney at or before 20 days of served date.) Legal opinions are greatly appreciated.

File an answer in the form of a general denial.

Copy the HEADING at the top of the page.

Title your document "Respondent's Original Answer."

The body of the document will simply state "The Respondent JOE CLEAVER denies everything."

Underneath that, sign it - use a signature block that includes your address and telephone number.

File the original with the clerk of the district court of Grayson County; you can do it by mail. Their address is:

Your cover letter simply says, "Please file this among the papers of this case."
