Legal Question in Family Law in Texas

Settlement Entitlement

I married my husband in the hospital after a seriour car wreck. Since, we filed suit (only in his name) and receieved a large settlement from the wreck. We are now not getting along. Would I be entitled to any of the settlement? He also sold my vechile I came into the marrage with for a newer ''safer'' one but it is not paid off. I couldn;t afford the notes on my own. He padi cash for his ford. Would he have to provide me with a vechile? We also have a five year old daughter that I am afraid with a good attorney on his side I could lose. ANy suggestions?

Re: Settlement Entitlement

You say that the lawsuit was only in his name. If so, then it is probably entirely his separate property. You need to look at how the money was allocated at settlement.

Assets and debts are divided at divorce. How they are divided are either decided by the parties or the Judge divides all assets and debts.

In regard to the minor child, if you are concerned about your rights, then you need to retain the services of an experienced family law attorney.

I hope this information is helpful and is not confusing.

Good luck!
