Legal Question in Family Law in Texas
sex offender mother's rights
The mother of my grandson is in prison for aggravated sexual assult of a
child, her oldest son. I have guardianship of my 4yr old grandson, born after
the arrest.
He is my son's child. CPS didn't want to give him custody because they were
unsure about his characater. Rather than having to wait for all the red tape
we petitioned the court for custody and won. My son is the co-custodial.
What rights will she have when she gets out? She is serving 4 yrs. for failing
to register. She was up for early parole but it wasn't granted. Had a 10yr.
probated sentence originally.
Her other children by different fathers are in foster care. What rights will she
have concerning them?

Re: sex offender mother's rights
Your questions can only be answered by the decree which was entered by the court. The mother had to have been acknowledged in that decree, and her parental rights and obligations defined. You are right to want to be properly prepared for the situation when she is released from prison. I strongly recommend that you have an attorney review the court orders in place, and advise you if you should seek additional, stricter orders. TCL
