Re: siblings custody

Your inquiry suggests you are in NY and I'm guessing the children are in TX. If that's the case, you can file a Petition for a Suit Affecting the Parent Child Relationship. The Court will probably appoint an attorney for the children. Unless there is something really bad wrong with you, you will probably get the custody you want. Really bad wrong? Like a drug user, child abuser, really bad stuff. I advise you to get an attorney for this project. It' not all cut and dried. Good Luck.

Where is the children's father? If he is alive, is he going to fight you? His stance in all this is important.

If he is also deceased or if the children have an estate (inheritance, life insurance proceeds, a future settlement from a wrongful death suit ...)you may need to go through the probate courts and establish guardianships over the children.

You need to actually talk with an attorney. Preferably one here in Texas (if that is where the children are) who handles both conservatorships and guardianships. If the children are in Houston or the surrounding area feel free to call my office.
