co sign for auto loan

I am living with a lady who cosign for my car. I would like my ex-wife back but this woman said we are common law married and we would have to go to divorce and have to divide the car. I am paying the car notes. We are together for 5 month . What is the rules for common law marriage

The rules for a common-law marriage are:

Texas Family Code 2.401: the man and woman agreed to be married and after

the agreement they lived together in this state as husband and wife

and there represented to others that they were married.
