signing over rights
can a father sign over his rights to the child to the paternal grandparents with out the mothers consent

I'm not sure what you are asking.
If the paternal grandparents want custody, both parents need to be notified of the pending lawsuit. If the mother cannot be located, then an attorney will be appointed to try to locate her and her notice will be through "publication".
So, technically, the mother must have notice.
However, legally, she might not personally know about the legal proceeding.
A person cannot "hide" to try to avoid a lawsuit moving forward. There are legal procedures in place so that attempts are made to give the mother notice but a lawsuit can be finalized without mother being there or giving her permission.
