Legal Question in Family Law in Texas

I am a single mom with a 3 yr old Daughter. On the birth certificate only my name appears but he has been order to and is paying child support. My question is to I need to file for sole custody of her?

You need to hire a lawyer. Usually the Attorney General does not get involved in issues of conservatorship or visitation, only child support. At some point paternity was established and it led to the order of child support. Absent some unusual circumstande, the parents are appointed Joint Managing Conservators, one being primary and the other with Standard Possession. It isn't based upon whether his name is on the birth certificate, but what is in the child's best interest.
