Legal Question in Family Law in Texas

I'm a single mother who has been divorce from child father. He has retire from military and left me and my child oversea( Japan). He complete the divorce process while I was hospitalize. He has custody of our child, but I had her here with me for the last six years since the divorce was final. What can I do at this point?

If I understand your letter, you and the child currently reside in Japan and the father resides in the United States. He has legal custody according the the order but you have had physical possession of the child for the past six years.

Does the father see the child? How old is the child? These are important questions. You can file in the same court that the original order was filed in and ask the court to modify the orders. If you have been in knowing violation of the orders, that might be a problem.

Is the father trying to assert his rights? If not, it might be better for you not to stir things up.
