Legal Question in Family Law in Texas

i am a single mother of 3, the oldest childs father is on the birth certificate and there is an acknowledgement of paternity on file with the state. he has been gone almost a year with no support for me or the children. what are my rights as far as custody.

If there are no orders regarding the child, you both have equal rights. He could show up at any time. If you have moved on and married someone, you could file a petition for involuntary termination of parental rights + step parent adoption.

If there is not a step-parent ready to adopt, it's not easy to get the other parent terminated.

You can sue him for child support. That would give him court-ordered access to the child, but only as per a written order. Now he has equal rights with you and could show up at any time.
