Legal Question in Family Law in Texas

Single Mother Rights

I'm expecting to be a single mother. The father and I weren't married and he's a convicted fellon/addict. He has not been responsive but I'm afraid once the child is born he'll want parental rights. I do not want child support or his involvement. How can I ensure sole custody? Will keeping his name off the birth certificate help? Also, what can I do to ensure my mother gains custody of my child if something were to happen to me?

Re: Single Mother Rights

Although I understand your concerns, you cannot insure what you are asking for. To answer your last question, the can be assured only if his parental rights are terminated. It is rare for a judge to be willing to terminate parental rights, without a stepparent ready to step into the financial shoes of a parent.

If all of your allegations are documented by admissible evidence, then if he makes a claim for visitation/conservatorship, then you have an argument for supervised or restricted visitation.
