Legal Question in Family Law in Texas

single parent confused

I am 28 years old. A single parent of an 18 month boy. When he was born, his father did not want his name on the birth cert. He does not pay child support and has not had any contact with my son for 15 months. My question is, if I passed away, would he have any legal right to take my son from my parents? My mother told me that I should write a letter with my intentions of giving my parents custody the day that I die. Please answer this question for me. I need to be prepared for anything.

You need to write a will.

You will need an attorney that does wills and probate matters.

You would need to talk to a family law attorney about his rights. It is somewhat complicated and too difficult to discuss in an email.
