Legal Question in Family Law in Texas
My sister had her 9 year old daughter taken away from her by cps three years ago. she was involved in drug activity and a drug user. they determined after 90 days she could not get her daughter back. she continuosly failed drug test and so on. since then she has done jail time for shop lifting, which because she had numerous it became felonies. she was in state jail for a year and after she got out she got caught again and went to the county jail in dallas for 4 or 5 months. anyway, i need to get some sort of legal papers or something giving me permission to get health insurance for her and so on. we were told (me and my husband) it would cost 3000 to get legal gaurdianship of her, which at this moment we cant afford. we took her in instead of letting her go to the foster system because we wanted to. my sister gave us a 2 sentence note saying i had permission to see she gets emergency health care and an education. i need something more...what do we need to do about this. she still is not stable. thank you

You need to get conservatorship of your niece. Is CPS still involved? They have the authority to petition the court for your conservatorship. If CPS handles it, it should not be at a cost to you. If they are not involved, then who is the primary conservator? It may cost $3000 in legal fees, but many attorneys will charge their fees on a payment plan. Contact the State Bar for a referral to low cost legal services.
