Legal Question in Family Law in Texas

I am in a situation to where my 18 year old son which is still in school went to live with his mother. Now in the Divorce Decree it had stated that our children were to live with me and she paid 50.00 a month per child in child support. I received a phone call from Harris County telling me that my son needed to be living with me since the divorce decree stated so. The Divorce Decree also stated that she was to pay child support till the age of 18. Why is it that he is not able to live with his mother and her not pay the 50.00 a month child support for him?

I would need to know who in Harris County called you.

Was it CPS? If so, there has been a problem at her house and CPS wants him to leave her home.

Technically if the child is over the age of 18 he is now considered an adult. He can do whatever he wants. The Divorce Decree ends when he turns 18 - expect for child support that would continue until he graduates from high school or a court determines that it should stop.

I recommend that you talk to a family law attorney in your county. I assume that it is Harris County.
