Legal Question in Family Law in Texas

I am sixteen and expecting my first child. The father of my child is sixteen as well. He just got a job and is helping to support our baby when it gets here. We do not live together. Therefore, she will be primarly living with me for the time being. I am signed up for wic and medicaid. Will he still have to pay child support if I am not filing for it? I do not see where it would be right for him to have to seeing how he is a part of the child's life and is still a minor as well.

If the Attorney General gets involved, yes, he will have to pay child support. They will ask for it, and the Judge will say "yes." If you've signed up for WIC and Medicaid, my guess is that you've already talked with the Attorney General.

The reason that he has to pay child support is that this isn't a "private matter" anymore; you're receiving taxpayers' money to help you with the child. Therefore the State has an interest.

I agree with Mark Dunn. You have involved the Texas taxpayers to raise your child. Now the TX AG is involved on their behalf. When you signed up for WIC and Medicaid you also gave them permission to go after him for child support.

To be blunt, you are not supporting your child, the taxpayers are paying for your child. The taxpayers do not want to pay for your child. Therefore, the TX A G is going to the taxpayers reimbursed for the money that you are receiving.

Once you accept one penny of money, you have opened a door that you can never close.
