Legal Question in Family Law in Texas

Sliding Scale

Can anyone tell me of an attorney or agency that will work on a sliding scale? My ex pays child support hit and miss (loosely translated, he's the type that switch jobs to avoid paying) he pays maybe 5 months out of the year and he owes so much back child support $12k. Now he's dropped medical insurance, I found out that little diddy when I got my credit report and saw all the past-unpaid medical bills. How does the old saying goes, one gets as much justice as one can afford. I can't afford much, but anything would help.

Re: Sliding Scale

have you talked to the AG's office. Your ex meets the standards for the AG's most wanted list for deadbeat dads. They just caught a guy down here who owed $24K and put him in jail. Maybe that would motivate him to pay cs. Now they are looking for guys who owe $5-$10k.

Re: Sliding Scale

You have several options. First, the Texas Attorney General takes child support cases, particularly ones in which public funds have been paid that should have been paid by the non-paying parent. It typically takes a long time to go through that channel, though.

I assume that Dallas has similar services as my hometown of Austin. Call the Dallas County Bar association and see if you can get a phone number for a Legal Aid office. Here, if Legal Aid does not take your case, they often refer you to a local volunteer association that has attorneys that handle pro bono (free) family law matters.

Also, there may be a fee reduction system in place for certain cases. Again check with the local bar association.

Finally, most attorneys are expected (but not required) to provide pro bono services each year. You might call a few firms in town and inquire as to whether they do that.

Good luck.
