Legal Question in Family Law in Texas
Sole custody
Can my husband sue me for sole custody and make me leave my home. I recently went through rehab for a drug problem that stemmed from my finding out that my husband was bisexual transvestite. I spent money I should not have but I did not ever go to jail or put my child in danger or use drugs around my child ever. I know I was wrong but I have been clean for going on 3 months and I am working hard with a support group. My husband is threatening me with taking my child (3 years old) and has filed a restraining order against me for reason Im not sure of. There has never been any violence on my part. He just wants me to leave the house and my child. I have no family I can go to and he has a brother and numerous friends that can help him. Plus he is gainfully employed. What should I do? Can he take my child because I went to rehab? Can he take my house? My name is on the mortgage papers. Its my house too. Any advise would be greatly appreciate. He has emptied the accounts and I am penniless right now. Thank you in advance for you assistance.

Re: Sole custody
You need an attorney. You can call Lone Star Legal -- I don't know their phone number or Houston Volunteer Lawyers Program at 713-228-0732 for free legal help.
I cannot answer your questions without seeing the legal documents he has filed.
You can certainly call the constable or police and let them see the papers and ask them if they would arrest you if you stayed in the home.
You need to appear at the hearing.
We offer a payment plan but our deposit is approximately $1,000.
