Legal Question in Family Law in Texas
I have had sole custody of my 8 year old son for 4 years. (Ex wife has mental issues, bipolar, neglect, anger, domestic violence towards me for 3 years , which is documented. I also have been arrested for domestic violence because I held her down in a supression hold the last she attacked me which was just before I left her before our divorce until she quit fighting me and I got arrested when she called her friend to tell her we had gotten into and arguement and her friend called the police) We were divorced in AZ, ex wife was given visitation and decree says no child support at this time. 2 years ago exwife moved to Dallas area. She rarely drove down to see my son. I have relocated abroad (military). After arriving abroad, I took my son to see a Counselor because of his school behavior. Found out he is ADHD and has been sexually abused by his mother He does not want to talk to his mother via telelphone and when I forced him to talk to her on the phone his behavior became violent at home and at school for several days after talking to her so I took him to see a psychiatrist. The psychiatrist is the one who said that he has been abused by his mother. My ex just had me served with papers for Emergency Temporary Custody and Child support saying that I am injuring my son by not allowing him to talk to her on the phone and she want s child support until the Judge makes a decision. She also said in her affidavit that I have been keeping her from seeing our son. There is notheing in the divorce papers that say there is a geographic restriction and nothing in the divorce papers that say I am responsible for her travel or my son's travel for visitation. Exwife has not travelled to see our son since we moved. She has only called. She never even sent him cards, letters or gifts for his birthday or Christmas. It looks like I am in BIG trouble for acting like a responsible parent and looking out for the best interest of my son and taking him to get help and doing what the dr said by allowing no phone contact until my son is more stable. Besides hiring an atty,(Please refer one to me) what else do I need to do and am I going to lose my son? The court is 246th Harris County. I need help soon. Thank you.
