Legal Question in Family Law in Texas

Can I get sole custody of my three yr old son in my divorce if drugs and violence were a big part of the marriage? I don't have evidence of drug use, but I plan on getting a hair follicle done soon. The last act of violence was reported to the authorities over two years ago. What are my options in making sure he can never be alone with my son? I have no money for an attorney and have to do it all myself.

If you do it all by yourself, it is unlikely that you will achieve your objective of keeping him away from your child. You need to come to terms with that. These are not simple matters of filling out this form or showing that exhibit and, voila, the court sees the clear path to the right decision.

You need to hire an attorney. Call Legal Aid. Call the Texas Legal Services Center (www.tlsc.org). Call the county bar association. See if any attorneys in your area will accept payment plans. If your husband has any cash laying around and you can tell the court where it is, you have a good chance that the court will order him to pay your attorney fees.
