Legal Question in Family Law in Texas

My son and daughter in-law take care of her minor brother (14) who receives social security about 2500.00 month. But they do not receive the check the mother does. She will not give them any money. But the boy will not go back to live with her do to her boy friend. The question is what can they do to get him legal and the money without taking her to court

They probably have standing under the Family Code to file an original petition that asks that they be appointed managing conservators of the child. In other words, they have to take her to court.

If Mom is receiving social security money for the child but the child doesn't live with her, they should report her to the social security administration.
