son and daughter in law

my son had an affair and his wife know about it. They have agreed to go to counseling because of the two small kids but she seems to have already checked out of the marriage. he has always heard that the person who files usually fairs better financially. If she files before he does how will the fact that he had an affair hurt him financially in the divorce.

Ah the joy of rumors! More common is the one that says the one who files first automatically gets the kids.

No matter who files, his actions may hurt him. How much depends on a number of things.
