Legal Question in Family Law in Texas

My son and his girlfriend have a two year old son together. They recently broke up and my son moved from Texas to Louisiana. The mother of his child called and asked him to take his son because she has no desire to raise a child at this time. She wants to experience life while she is young. The child has her last name. My son wants his child and is going to pick him up. How will this affect schooling and other situations when he does not have his father last name, and can she change her mind later and just come get him?

Your son needs to get legal custody of this child and change his last name!

I don't recommend that he go to the TX A G office!

If your son has established residence in LA, then he may want to file for primary conservatorship in Louisiana.
