Legal Question in Family Law in Texas

My son is in jail from non-child support payments he had just got a job right before he was to go to court. He was only able to save $300.00 that's what he had and give that to the atty general. but he still got put in jail. my question is can he request paperwork to modified? I was told at the time of his court they wanted $1500.00 now I just call to check how much he needed they said$5000.00. Can that be true or can they have him mistaken by another person cause he does have a cousin of his there for that toochild-support? I didn't have his ss# or case# when I call. now the mom got put in jail for theif with goverment help food stamps she got bail out the same her house where she livess with her husband and her 3 children got raided for drugs. Well she be given a jail time when she goes to court for the food stamp case? What can we do to get our grandchild and help my son get out of jail so he can pay his chiild support?

1. Your son in jail:

Take a look at the order that put him in jail (you'll need to go to the courthouse - the District Clerk's office - and get a copy, and then take it to a lawyer). The order itself will tell what has to be done to get him out of jail.

Yes, he can request that his child support be modified. He files a motion to modify and has it served on Mom AND the Attorney General.

2. Mom and the food stamp case:

What happens to her is up to the Judge and the DA. She needs to get a lawyer.
