Legal Question in Family Law in Texas
MY EX SON IN LAW HAS FILED FOR CUSTODY OF HIS 3 CHILDREN, MY GRANDSONS. TWO OF THEM ARE 11 AND 7, BUT THE OLDEST IS ALMOST 18. MY EX SON IN LAW PREPARED A COURT ORDER NAMING ONLY HIMSELF AND MY DAUGHTER IN THE CHILD CUSTODY SUIT, BUT HE HAS PUT MY NAME IN AS TEMPORARY GUARDIAN OF MY OLDEST GRANDSON AND ASLO APPOINTED ME AS SUPERVISOR WHEN MY DAUGHTER IS WITH THE CHILDREN, INCLUDING MY GRANDSON WHO IS ALMOST 18. THERE ARE MANY DO'S AND DON'TS WHICH INCLUDE ME, BUT THE ONLY TWO NAMES THAT APPEAR ON THE COURT ORDER TO BE SIGNED, ARE MY EX SON IN LAW AND MY DAUGHTER. I HAVE NOT SIGNED ANYTHING OR MADE ANY VERBAL AGREEMENTS WITH MY EX SON IN LAW IN REGARD TO THE COURT PAPERS. IS THIS A LEGAL BINDING DOCUMENT FOR ME EVEN THOUGH MY SIGNATURE IS NO WHERE ON THE DOCUMENT. I HOPE THAT YOU CAN ANSWER MY QUESTION AND i APPRECIATE YOUR HELP AND ADVICE IN THIS MATTER. Were you ever served with pleadings? Were you ever made a party to the case? Have you ever been appointed as a guardian or conservator? Did you sign any kind of waiver or agreed order?
If the answer to all these questions is "no," then the court doesn't have jurisdiction over you, and doesn't have the authority to order you to do anything.
I recommend that you sit down with an attorney and show the legal documents to an attorney and have a licensed TX attorney review the paperwork.
If your daughter has an attorney, have that attorney review the paperwork.
Without looking at the paperwork, I cannot give you my legal opinion.
