Legal Question in Family Law in Texas

My son wants to live here with me.

I am a resident of central west texas and my 14 yr old son has said that he wants to live here with me. What must I do and how, and what will the cost be, moneywise? He lives in a city in east texas and we are certain that his mother will contest. He is afraid she will not allow him to have his belongings as well. Please advise me of the most practical and amicable course of action.

You will need to seek a modification of the original court order regarding conservatorship. Since your son is 14, he can submit an affidavit to the court expressing his wish to live with you. The court will consider this but ultimately the judge will make the determination based on what he/she deems to be in the best interest of the child.

You will have to file a motion to modify and have him execute an affadavit of choice. Depending on his maturity level and your ex's anger it could be easy or it could be hard. I would love to help. Please email me and we can discuss further.

You will need to file a motion to modify. One of the grounds for modification is that a child this age signs some paperwork indicating that he wishes to live with the other parent. Perhaps this is your best course.
