Legal Question in Family Law in Texas

Hello, My son is married and living separate from his wife and children . I want him to file for a legal separation. Will that stop his wife from running up bills and not paying rent ? How much would he be looking at to do this

Texas does not have separation. He must file for divorce.

Texas does not provide a legal mechanism such as a legal separation. If he does not want a divorce, but some rules need to be in place for the children, he can file a Suit Affecting Parent-Child Relationship. This will not resolve the issues of marital assets and debts.

Another alternative is to file for divorce, and ask the court for a Temporary Hearing to resolve issues regarding the marital estate and the children.
