Legal Question in Family Law in Texas
My son went to spend a few weeks with my parents when school let out. While he was gone, I went to jail for POS. By the time I got out 2 days later, my parents filed some papers and are trying to have me served. Supposedly the papers state that I have to take and pass a cuticle drug test, that goes back a year, before I can have my son back. They also filed a restraining order. Can they do that? Is there anything I can do? And if I have custody, can I determine who he stays with during this process?

It sounds like you voluntarily allowed your parents to have possession to your child. The child's father also needs to be notified of this legal process since he is the other person that should have custody of your child. I would hire an attorney immediately. Look on www.avvo.com for an attorney or this website.
