Legal Question in Family Law in Texas
I have a son that will be 14 in November. We live in Texas and have pretty much all of his life. He goes and stays with his dad in Virginia over the summers and it is always a fight to get him there. He never wants to go. Is there something in Texas law to where he can tell his dad that he does not want to go up there for the summer?

It is no longer unusual for visitation provisions to include specific language for kids over the age of 13. Sometimes the judge will take into consideration the child's activities, interests, etc regarding summer vacation. The child can also speak directly with the judge regarding his position, without the parents present. These situations vary tremendously from case to case, and from court to court. Speak with an attorney in your county about the options available to you.
