The answer to your question is: LEGALLY, he (the 16-year-old) has to go. YOU have been ordered to "surrender" your son to Dad (whatever that means).

I know of one judge who, if a 16-year-old refuses to go, will threaten the kid with Juvenile Hall.

I know another judge who won't do anything to the 16-year-old OR his mother.

You need to file a motion for modification of the order.

I would agree with what Mr. Dunn has stated above. A great deal will depend upon which Court/Judge will be deciding the issue. I would be glad to discuss this matter further with you if you would contact me directly.
