Legal Question in Family Law in Texas

My son is 6. I havent seem him in 3 years but I pay child support. The Grandmother has full custody of him with his mother having the normal visitation and me having no rights but to pay child support. The grandmother contacted me asking if I would be willing to terminate my rights so they could change his last name to their last name and she could adopt him. She also told me that her attorney told her that terminating my rights would end my obligation to pay child support. Remember, she contacted me asking this question.

Can you tell me if thats accurate? Will terminating my parental rights end me paying child support? Any info would be helpful and appreciated. We live in Texas.

If you are current on your child support, it's going to be difficult to terminate your parental rights. So you can certainly fight to begin to see your child. I don't understand why you are not visiting with your child. I can't understand why the mother visits with the child but the father is not seeing the child.

The grandmother can ask for you to terminate your rights but you don't have to agree to it.

I cannot answer if terminating your rights would terminate the child support without reading the paperwork. The paperwork would have to include the correct language to terminate the child support.

If you are behind on any child support the parental rights could be terminated but you could still owe the past due child support.

So, you really need to talk to an attorney and have an attorney reivew your paperwork!
