Legal Question in Family Law in Texas

My son's father has never seen him or made any atempt to but he pays child support. can i have my son's last name changed legally without having the dads rights signed over first? my son has my maiden name but he wants to have the same last name i do now that i am married to the man he calls dad.

If you want to change the child's name, you have to get the father served with your petition. You do NOT have to terminate his rights first. This is covered in Chapter 45 of the Family Code.
