Legal Question in Family Law in Texas
My sons father has not seen or spoken to him in 6 years. My son is now 8. My husband and I have been together 6 years and my son considers him his dad. He wants to legally adopt him. My ex refuses to sign over his rights out of spite regardless of the years of emotional and physical neglect. Do I have a case?

Has bio dad paid child support? Does bio dad have a violent or serious criminal history? Does dad have an addiction that would affect his parenting of his child? If he pays child support, and is not a danger to his child, an involuntary termination is unlikely. Contact an attorney in your area, with all of the facts and determine if there is a chance, and if so, the likelihood. It is a tall mountain to climb, but might be possible. Good luck.
