Split Custody
My son is 3ys old my ex and I have standered custody , but now he is threathing me he has started to try and have it were he gets him one week and I get him one week. He saids it is because he has a new baby girl that is 3mo. and it is not fare to her that my son dose not get to see her enough. I also have a older son that is not his that has known my youngest all his life I fill if his dose do it then he will be taking him away from the oldest. Can he do that and if so dose he need to prove something for it to be done? Also my son tells me he dose not want to go over there on the weekends, and crys. I told him he needs to tell his dad but he said he is afrade of what might happen. What can I do? Will someone please help me? PS I have not reseved any papers from the courts about it. If he has stated will I get anything from the courts or his Attorney (if he has one)? If he dose not have one will I get something from someone else?

First, there can be no changes in the current orders unless you are notified of the petition and the hearing date. If you are served by a process server or constable, hire a lawyer, as there are deadlines to meet.
Secondly, find out why your child is afraid to visit with his dad -- if there is a legitimate problem, you may need to investigate and limit visitation, through the courts.
