Legal Question in Family Law in Texas

Split property, vidoes, pictures of joint children

Can my ex-wife (10 years divorced) take me to court for vidoes, or copies, of our children while we were married? There is nothing in the original decree on ownership, but she voluntarily gave them up to me. I do not want to give her the originals, or make her copies, because some of these vidoes have scenes of me and my children after the divorce that have nothing to do with my ex-wife. All of these videos are of family oriented events, including sporting events, birthdays, and the like. I just do not want to submit anything to her. Can a court of law, in any way, force me to do so? Thanks.

Re: Split property, vidoes, pictures of joint children

Generally speaking, the decree was a final and complete division of property. There should be a phrase in the decree which refers to 'all personal property in your possession' and/or a phrase 'all property not otherwise listed'. Generally these phrases give the property to the person who has possession of the property at the time of the decree. It also presumes no fraud or deceit.

Therefore, although she can file suit, she is unlikely to be successful.
