Legal Question in Family Law in Texas

splitting assets while married

I'd like to split our assets in half now and remain married. Is there a way to do this and prevent my spouse from coming back later and demanding half of what I have again?

Re: splitting assets while married

You can draft a marital property agreement that splits the assets and classifies all the assets as separate property of one spouse or the other and all liabilities as separate debt of one spouse or the other. The divorce court can not divide separate property; therefore, the property agreement secures which party receives the assets and debts.

I suggest you hire an attorney to do the drafting work because it is a bit complicated.
