I would like an owelty clause in the divorce decree as a way of insuring that my spouse pays what he has agreed to in a mediated settlement agreement. He has repeatedly gone back on his word and I feel I need to have a lien on the house just incase he doesn't pay me. We are at a standstill on the owelty issue. I want it, he doesn't. Should I let it go so we can finalize the divorce or insist on the owelty clause?

You need to talk to your attorney.

Writing a free legal website is not appropriate for your question. You need to talk to your attorney because your attorney knows the details of your case.

You included in your question, that there was a mediated settlement agreement. Was owelty included in the msa? If not, the judge might not allow you to include the owelty clause.

If he does not do what he will say he will do, then file contempt on him.

My guess is that if you are talking about owelty clauses, you have an attorney and should be discussing this with him or her.
