Legal Question in Family Law in Texas

Spousal Waiver Should I Sign???

Husband sent me a spousal waiver for 401 K, 1 page to sign. Do not know how much he is taking out. Retired this month. We are seperated, live in two states. Am I to share in any part of this money?

Should I sign??? will this hurt me in the long run? Thank you very much, really need an answer quick. He keeps calling to see if I have signed!

Re: Spousal Waiver Should I Sign???

Without knowing far more information, my answer is do NOT sign it. Texas does not have a legal separation. If you sign it, he could realistically drain the account, leaving you with nothing, even though you could be entitled to at least half of the balance. Please contact an attorney to protect yourself, and if necessary, file for divorce.
