Legal Question in Family Law in Texas

ex spouse gave my children to her mother

My ex wife has taken my chidren 150 miles away and left them with her mother because she can no longer take care of them. Neither her or husband have a job. She refuses to comunicate with me and i have been denied visitation for 3 months now.My ex wife still lives 15 minutes from my home but lied and said she lives with her mother in order to enroll them in school in her mothers school district. I have always paid child support and up to 3 months ago have always had visitation with them. My ex wife makes no secret to the fact that she still lives here and feels she has every right to leave my chidren with her mother. My ex wife and her mother have refused to give me a phsical address to where my chidren are. My question is, can she do this to me and if she can not care for the children should'nt they be with me?

Re: ex spouse gave my children to her mother

you should make a police report of your attempts to exercise visitation. these must be documented. you can file a motion for contempt for your ex-wife's failure to abide by visitation. you can also file a motion to modify to change primary custody to you. none of these things are automatic and will likely require the services of a lawyer.
