how to get my spouse to leave

I want a separation and possibly divorce but my husband will not leave the house. How can I make him leave?? The house we live in is financed in my mother's name but I am making the payments. She passed away in December and left the house to me. The house does not belong to him in any way, he is not working and does not make any payments. How can I force him out of this house?

I believe that you need to file for divorce and ask for temporary orders. At the temp. order hearing, the Judge may order him to move.
