Legal Question in Family Law in Texas

my spouse and i have a 10 month old and i do not think were going to last weve called it quits but still live together im the only one working and being the house mom... i want to make sure my son is ensure but that my spouse dosent try to take our 10 month old or hold him for a court date he dosent work not yet, it may be in a few weeks what do i do so that i know ill be safe with my son..... is there legal documents that i have to have in writting?

You need to take these steps:

1. Hire a family law attorney to help you through this process. It's not simple.

2. File a Petition for Divorce and ask for Temporary Orders naming you as the conservator with the exclusive right to designate the primary residence of the child.

3. Negotiate a settlement.

4. Mediate if you can't settle.

5. Finalize your divorce.

The first two steps are the most critical.
