Standard Possession
How can I interpret the wording for holiday visitation and how the alternate weekends apply? My ex-husband has our daughter this year for the holidays, but the weekend included in that time happens to be mine. Do I follow the holiday schedule or the year round shedule where the alternate weekends are outlined. Am I right to get my daughter in that weekend? Or does he keep her consecutively for those 12 days?

The holiday visitation controls. If you want a week-end in the middle you should communicate with the father, and remind him that there will be times when the shoe is on the other foot. Work together to do what is best for your child(ren).

Normally Christmas visits supersede weekends. I am not sure of your location, but the Christmas for my kids at Carrollton/FB ISD is lopsided. The Std order gives one party from the time school is released until Dec. 26 at Noon and the other parent gets Dec. 26 at Noon until the day before the kids go back to school. As applied to this year, one parent would get from 6:00 pm on Dec. 21 until Dec. 26 at Noon and the other parent would get Dec. 26 at Noon until January 8. While this seems unfair, the schedule does flip-flop each year so it evens out over the years. If you would like me to review your specific decree language, please call me at (972) 481-7990.
