Legal Question in Family Law in Texas

Well someone help me?

My ex and I have standered custody of our son. It saids in the court papers he is to pick him up and bring him home. But in the last few weeks he saids if I want him back I have to go and get him my self, the only thing is he lives 40 mils. from me and right now I do not have a car that works to go and get him. I have to ask a friend or family member to take me out there. If I do not go and get him then he will not bring him back to me. (ever) What can I do? Also he saids he is going to get full custody of him. I do not want that to happen do I have anything to worry about? Will it be easy for him to do it? Will someone please adv. me on these questins so I can putmy mind to ese. Thank you.

The custody issue could be an empty threat, or he could be serious about it. Sole conservatorship, or change of conservatorship is never easy. It is impossible to know if you should be concerned without having additional information about your situation.

His refusal to return the child, especially knowing that it creates such a hardship for you and for the child, is solid grounds to file a Petition for Enforcement. Under these circumstances, the judge could well order him to reimburse your attorney fees.
