Legal Question in Family Law in Texas

What state do I file a motion for a stay in child support?

I have gotten divorced in Tarrant County, Texas in 1998. The ex moved to Montana with the kids moments after the divorce. I have been out of work for the past 1.5 years and owe back child support. I need to file a motion for a stay in child support immediately. In which state do I file? In Texas or in Montana. If I file in Texas can she move it to Montana? I cannot afford to hire an attorney in Texas and then find out it was move to Montana. My funds are bare to none and cannot afford to move to the wrong state. Kindly help me with my situation.

So sorry, but you are here and she is there. You might want to hire a Montana lawyer to file a motion to transfer the case to Montana. I would file a motion in Tarrant County to modify the child support based on current income and make her hire someone to transfer it or make her contest the matter in Texas while she is in Montana.
