Where may an individual who is currently out of the country as a member of the armed services, file a petition for divorce?

It depends. IF you were a resident of Texas, then your time outside the state while serving in the military does not count against you and you are considered a resident of the state and the county in which you lived. (Texas Family Code Section 6.303)

IF you spouse has lived in Texas for at least 6 months, you may file for divorce in the county where he or she resides at the time that the petition is filed. (TFC 6.302)

It all depends on the actual circumstances.
