In the state of Texas, how long do you have to be married before a divorce for the other party to get half of what you have earned?

Anything earned during the marriage is community property. However, even if you were to file for divorce the day you were married, a divorce court cannot grant a divorce until 60 days after the petition is filed. So there is going to be at least 2 months of community income earned during the divorce. In awarding community property, the court looks at the community property the parties have when they are divorcing.
