In the state of Texas, if two people are not married and they are having a baby, whose last name does the baby take? Is it a choice or the does the law mandate the baby take the last name of the mother or father?

The law does not mandate the child's last name.

Usually, in a paternity suit, a judge will give the child the father's last name (if the father requests it).
