Out of state vistiation parent has warrants
My ex wife has warrants issued out for her in the state of Texas.
She is to pick up and drop off our son for summer visitation. She said that she will be here Friday. If she were arrested in Texas on the warrants, what are my options? Do I still let her take him once she is released?
She also says that she is not bringing him back. If I have to go to North Carolina to get him can I file contempt charges against her?

Re: Out of state vistiation parent has warrants
Is your decree in Texas or in North Carolina? If it is in a different state than the enforcement action, then you have to get the decree registered and recognized in that state. What are the warrants for? If minor, such as unpaid traffic tickets, then it is doubtful that the court will take drastic action as to custody. If it is a serious matter, and you believe your child will be in trouble if returned to her, then file for a modification, as well as an enforcement. Any action you take is going to require the services of an attorney.
