Legal Question in Family Law in Texas

I was stationed in South Korean with the US Army. Married a Korean national through the US Embassy in 1980. Returning to the States we were married by the church. I called the court house in my hometown and was told that the marriage was never registered. I retired from the military in 2002 and have been seperated for 1 year, she living in North Carolina in our jointly owned home and me living in Texas. My question is do I need to file for divorce in order to remarry?

Yes. You are married. In Texas one can be married without a license of any kind, and the facts of your situation constitute a legal marriage.

I am assuming that you and she did live together as husband and wife in Texas.
